Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and LootCollect (the “Service”, “we”, “us”), operated by [Operating Entity Name], [registered address]. By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 16 (EEA/UK) or 13 (United States), or the age of majority where you live, and able to form a binding contract. By using the Service you confirm you meet these requirements.
2. The Service — a tool that acts on your instructions
LootCollect is a cloud scheduler that transmits recurring web requests to the target endpoints you configure, on a schedule you set. We provide the automation only; we do not operate the destination websites and cannot guarantee that any request will be accepted, processed, or credited by them.
You direct the Service; the Service does not act on its own. When you create or enable a schedule, you instruct and authorize the Service to transmit, on your behalf and at your direction, the requests and submissions you have defined. You are the originator and author of those requests, and the Service is only a neutral technical means of transmitting them. Any request or submission made through the Service is your own act, made by you, and you are solely responsible for it. We do not review, approve, monitor, or endorse the targets you configure or whether sending requests to them is permitted.
3. Your account
You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account, including every schedule, target, and request configured under it. Notify us promptly of any unauthorized use.
4. Fees — currently free
The Service is currently free to use until further notice. We reserve the right, at our sole discretion, to introduce fees, paid plans, or credit charges at any time. If we do, we will make the pricing available before it takes effect, and paid features will only apply on a going-forward basis — you will never be charged money without prior notice and, where required, your consent. Any credits shown in your account are promotional, have no cash value, are non-transferable and non-refundable, and may be adjusted or expired.
5. Your responsibilities, authorizations & representations
You are solely responsible for what you configure and for every request the Service sends on your instructions. Each time a request is transmitted on your behalf, you represent and warrant that:
- you own, operate, or are authorized by the relevant owner of each target to send the requests and submissions you configure to it;
- you are authorized to use every username, identifier, email address, account, credential, or other data you provide;
- your configuration and the resulting requests comply with all applicable laws and with the terms of service, rules, rate limits, and policies of each target website or service;
- you have independently determined that automated, scheduled, or proxied requests are permitted for each target and in your jurisdiction, and you accept responsibility for that determination;
- the content you submit is accurate and is not misleading, fraudulent, infringing, or otherwise unlawful.
You — not LootCollect — are responsible for deciding whether, where, and how often to send requests, and for the consequences of doing so. We do not provide legal advice and make no representation that any particular use is permitted by any target or by law.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent, or abusive purpose;
- Use the Service in a way that violates the terms, rules, or rate limits of any third-party website or service you target;
- Target endpoints, listings, servers, or accounts you do not own or are not authorized to use, or impersonate others;
- Interfere with, overload, reverse engineer, or attempt to gain unauthorized access to the Service or its infrastructure, or to any target;
- Resell or provide the Service to third parties without our permission;
- Create multiple accounts to abuse promotions or free usage.
7. Third-party websites & assumption of risk
The destination websites and services you target are operated by others and have their own terms. You are solely responsible for ensuring your use of the Service complies with those websites’ rules. They may change their rules, reject automated requests, or penalize accounts. We are not responsible for their actions, availability, or decisions.
You acknowledge and accept that some target websites or services restrict or prohibit automated, scripted, or proxied requests, and may attempt to detect them. You decide, at your own discretion and risk, whether to use the Service against any target. You assume all risk and all consequences of that decision, including the rejection, removal, or non-acceptance of requests; rate-limiting; IP, account, or device blocks; the suspension, restriction, or penalization of your accounts or access at the target; and any other action taken by a target operator or third party. We are not liable for any of these outcomes.
8. Intellectual property
The Service, including its software, design, and branding, is owned by us or our licensors and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain ownership of the content you submit.
9. Suspension & termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (e.g. disclaimers, liability, indemnity) will survive.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that requests will be accepted by third-party sites. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer-protection rights in the EEA/UK.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Because the Service is currently free, our total aggregate liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim (which may be zero) or EUR 50. This does not limit liability that cannot be limited by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless LootCollect and its operators, owners, employees, and contractors from and against any and all claims, demands, investigations, liabilities, damages, losses, and costs (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) any request or submission made on your instructions; (c) your breach of these Terms or of your representations in Section 5; or (d) your violation of any law or of the terms, rules, or rights of any third party. This expressly includes any claim brought by, or arising from your interaction with, any target website or its operator, any claim that your use infringed a third party’s rights or breached a website’s terms, and any related regulatory action. We may assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate with us.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new date and, for material changes, take reasonable steps to notify you. Continued use after changes take effect means you accept them.
14. Governing law & disputes
These Terms are governed by the laws of [governing-law jurisdiction], without regard to conflict-of-laws rules, and disputes will be subject to the courts of [venue]. If you are a consumer in the EEA/UK, you benefit from the mandatory protections of your country of residence, and the EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
